The differences between the Shiv Sena and the BJP have been amplifying over the last many days and what they are unable to arrive at a consensus about is the formation of a new government in the state of Maharashtra. The conflict and differences between the two political parties over the formation of the government has been going on in Maharashtra since the last two weeks now. The interesting thing however is that now the conflict must reach a conclusion because the term of the current assembly shall expire tomorrow. What is disturbing is the fact that with the expiration date of the assembly around the corner there seems to be no end in sight for the government formation in Maharashtra. It is such a delay that may lead to a constitutional crisis in the state. Two weeks have already passed since the results of the assembly elections were announced but conflict between the two parties Shiv Sena and the BJP over the chief minster’s chair. The term of the present assembly shall expire on November 9 and with resolution on in sight, it is predicted that Maharashtra may be heading for President’s rule . But this may not be the vase even if the BJP(105) seats and the Sena(56), which together have 161 out of the assembly’s 288 seats, fail to resolve their differnces. The new assembly will come into control immediately after the term of the previous one expires, even if there is no government formation. This means that the new MLAs will be sworn in and will start getting their salaries, allowances etc. President’s rule may be imposed on the state for six months after which the Election Commission will have to announce fresh polls in Maharashtra. Meanwhile if any political party emerges with a majority, President’s rule can be dissolved.
